The procedure in the national Phase

BB.01 TRANSLATION (CORRECTION)
Errors in the translation of the international application can be corrected with reference to the text of the international application as filed (refer to National Phase, paragraphs 6.002 and 6.003).
BB.02 FEES (MANNER OF PAYMENT)

The manner of payment of the fees indicated in the Summary and in this Chapter is outlined in Annex BB.I.
BB.03 DESIGNATION OF THE INVENTOR
PA Sec. 18(2)
If the applicant is not the inventor, a statement by the inventor must be filed justifying the applicant’s right to the invention.
BB.04 POWER OF ATTORNEY
PA Sec. 17(5)
An agent must be appointed by filing a power of attorney. A model is given in Annex BB.II.
BB.05 ANNUAL FEES
PA Sec. 29
They are payable before the second and each subsequent anniversary of the international filing date. For the due date of the payment of the first annual fee, refer to the Summary. Where the applicant failed to pay by the due date, payment can still be made, together with a surcharge for late payment, within the six months following the due date. The amounts of the annual fees are indicated in Annex BB.I.
BB.06 FEE FOR GRANT

A fee for grant must be paid before the grant of the patent. The amount of the said fee is indicated in Annex BB.I.
BB.07 AMENDMENT OF THE APPLICATION; TIME LIMITS
PCT Art. 28, PCT Art. 41, PA Sec. 20
Amendments may be made in the national phase up to the grant of the patent, provided that the scope of the subject matter of the application is not broadened thereby.
BB.08 REVIEW UNDER ARTICLE 25 OF THE PCT
PCT Art. 25, PCT Rule 51, PA Sec. 51
The applicable procedure is outlined in paragraphs 6.018 to 6.021 of the National Phase. If, upon review under PCT Article 25, the Office denies an error or omission on the part of the receiving Office or the International Bureau, an appeal against this decision may be lodged to the High Court by a notice of motion within 30 days from the date of receipt of the decision. Any person aggrieved by any decision or act of the Office may lodge an appeal against the decision or act to the High Court.
BB.09 EXCUSE OF DELAYS IN MEETING TIME LIMITS
PCT Art. 24(2), PCT Art. 48(2), PR Rule 44
Where the applicant failed to comply with a time limit during the international phase or before the Office, he may request extension of time. Such request must be addressed to the Office together with an affidavit setting forth the relevant facts and is subject to the payment of a special fee (refer to Annex BB.I). Extension of time may be requested either before or after the expiration of the time. The extension may be granted by the Office for such period as the Office thinks suitable in the circumstances of the case.

How can payment of fees be effected?
Payment must be made in Barbados dollars, but the equivalent amount in a foreign currency that is convertible in Barbados may be accepted. Fees may be paid by cheque, bank draft or money order to the Registrar of the Corporate Affairs and Intellectual Property Office or by cash at the Office.
