National Phase

Summary of requirements for entry into the national phase

Time limits applicable for entry into the national phase:
Under PCT Article 22(1): 30 months from the priority date

If not already complied with within the time limit applicable under PCT Article 22 or 39(1), the applicant must comply with the requirement within 90 days after entry into the national phase. The Office will not issue an invitation to this effect.

The procedure in the national Phase

AE.01 TRANSLATION (CORRECTION)
Errors in the translation of the international application can be corrected with reference to the text of the international application as filed (refer to National Phase, paragraphs 6.002 and 6.003).
AE.02 FEES (MANNER OF PAYMENT)
The manner of payment of the fees indicated in the Summary and in this Chapter is outlined in Annex AE.I.
AE.03 EXAMINATION

The Office examines international patent applications as to substance. Within 60 days after publication of the decision to grant a patent, any interested party may file a petition to oppose the grant before a Committee set up in accordance with IPL Art. 66.1. If there is no opposition petition the patent shall be granted.
AE.04 ANNUAL FEES
IPL Art. 14, IPL Art. 38
Annual fees are payable in advance each year on the anniversary of the international filing date, beginning with the second year. Annual fees not paid within the applicable time limit may still be paid within six months from the expiration of that time limit but will be subject to payment of a surcharge. If annual fees are not paid within six months from the due date the patent shall lapse. The amounts of the annual fees are indicated in Annex AE.I.

AE.06 APPEALS

In case of a negative decision of the Office during the national phase, such decision may be appealed to the competent Court within a period of 60 days from the date of the notification.
AE.07 EXCUSE OF DELAYS IN MEETING TIME LIMITS

AE.08 UTILITY MODEL

If the applicant wishes to obtain a utility certificate instead of a patent or in addition to a patent, the applicant must, within the time limit applicable for the entry into the national phase, so indicate to the Office and pay the fees (refer to Annex AE.I).

How can payment of fees be effected?
All fees must be paid to the Office in United Arab Emirates dirhams, by online payment. All payments must indicate the application number (national, if already known; international, if the national number is not yet known), the name of the applicant and the category of fee being paid.
