    Upon entry into the national phase, Sakpatenti as a designated office or an elected office shall publish the international application in Georgian language as soon as the Georgian translation is submitted and the fee for examination as to form and publication of the application is paid. From the date of publication of the application in Georgian language the applicant shall be granted the provisional rights.

    Annex L - Deposits of Microorganisms and Other Biological Material

    Requirements of designated and elected Offices
    Only Offices whose applicable national law contains provisions concerning the deposits of microorganisms and other biological material are listed in Annex L. Unless otherwise indicated, deposits may be made for the purposes of patent procedure before these Offices with any depositary institution having acquired the status of international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure.

    National Phase

    Summary of requirements for entry into the national phase

    Time limits applicable for entry into the national phase:
    Under PCT Article 22(3): 31 months from the priority date

    The procedure in the national Phase

    GE.01 TRANSLATION (CORRECTION)
    Errors in the translation of the international application can be corrected with reference to the text of the international application as filed (refer to National Phase, paragraphs 6.002 and 6.003).
    GE.02 FEES (MANNER OF PAYMENT)

    The manner of payment of the fees indicated in the Summary and in this Chapter is outlined in Annex GE.I. The fee for examination as to form and publication of the application (up to 30 pages of the application) must be paid within one month from the date of request for entry into the national phase. The fee for examination as to form and publication of the application (for each additional page over 30) must be paid within one month from the date of the invitation to pay.
    GE.03 DEED OF TRANSFER
    PL Art. 24.3
    If the applicant is not the inventor, a deed of transfer must be furnished within two months from the date of the request for entry into the national phase. There is no special form for this statement. Legalization is not required.
    GE.04 POWER OF ATTORNEY
    PL Art. 24.2
    An agent must be appointed by filing a power of attorney within two months from the date of request for entry into the national phase. Any person who is a resident of Georgia or a patent attorney of Georgia may act as an agent. From 1 January 2025 an applicant not having a residence or a registered legal address in Georgia shall appoint a patent attorney of Georgia.
    GE.05 MENTION OF INVENTOR
    PL Art. 18.3
    If the inventor prefers to remain anonymous, a special request must be made to the Office during the national phase.
    GE.06 PRIORITY DOCUMENT (TRANSLATION)
    The Office may require the applicant to furnish a translation of the priority document into Georgian only in certain cases, and upon special invitation.
    GE.07 FEE FOR GRANT
    PL Art. 47
    Before issuance of the decision to grant the patent, the applicant is invited to pay the fee for registration of the patent, the publication of the patent and the issuance of the patent certificate within two months from the date of receipt of the invitation. If paid on time, the patent is granted, published and patent certificate issued. If the fee is not paid within the said time limit, the grant of patent will not take place and proceedings with regard to the application shall be terminated.
    GE.08 MAINTENANCE FEE

    A maintenance fee is due as from the third year after the international filing date. The maintenance fee is due on the anniversary of the filing date. If the maintenance fee is not paid in time, the application proceedings are terminated/the patent lapses. Reinstatement of the application is possible upon payment of the missed maintenance fee and a reinstatement fee, within six months from the date of termination of the application. If the patent maintenance fee is not paid in time, reinstatement of the patent may be requested. There is a six-month period from the due date for requesting reinstatement of the patent by paying the missed maintenance fee without surcharge, and an additional six-month period for requesting reinstatement of the patent by paying the maintenance fee and a reinstatement fee. The amounts of the maintenance fees are indicated in Annex GE.I.
    GE.09 REVIEW UNDER ARTICLE 25 OF THE PCT

    The applicable procedure is outlined in paragraphs 6.018 to 6.021 of the National Phase.
    GE.10 EXCUSE OF DELAYS IN MEETING TIME LIMITS

    Reference is made to paragraphs 6.022 to 6.027 of the National Phase.

    Reinstatement may be requested where the applicant has failed to comply with a time limit during the international phase or before the Office.
    A request for reinstatement of rights related with an international application, lost due to the non-respect of the time limit for entry into the national phase due to a justifiable reason, must be presented in writing within two months after removal of the cause of non-compliance with the time limit but not later than one year from the expiration of the time limit which has not been observed. The applicant must complete the omitted act and pay the reinstatement fee (indicated in Annex GE.I).
    Reinstatement of an international application in the national phase forfeited due to failure to meet a time limit is possible upon completing the omitted act and payment of a reinstatement fee, within six months from the date of termination of the application.
    GE.12 UTILITY MODEL
    PL Art. 73,

    If the applicant wishes his application to be treated as an application for the grant of a utility model, when performing the acts referred to in Article 22 or 39, he shall so indicate to the Office.
    GE.13
    Utility model protection cannot be obtained for microorganism strains, plant and animal cell cultures, biotechnology and genetic engineering subject-matters, substances obtained by chemical processes, including pharmaceutical substances.
    A utility model is registered after a limited substantive examination. Novelty is examined globally. Inventive step is not examined.
    A utility model application must contain only one independent claim.
    GE.14 CONVERSION
    An international application for a patent may be converted into a utility model application after the applicant has complied with the requirements for entry into the national phase for a patent application, as indicated in the Summary. Conversion can be requested before a decision of grant is issued.
    GE.15
    An international application for a utility model may be converted into a patent application after the applicant has complied with the requirements for entry into the national phase for a utility model application, as indicated in the Summary. Conversion can be requested before a decision of grant is issued.

    How can payment of fees be effected?
    The payment of fees must be effected in GEL equivalent in USD. If the applicant is not a resident in Georgia, the payment must be effected by an agent or a representative. All payments must indicate the application number, the name of the applicant and the category of fee being paid.
