    All payments should give the filing number (national patent), respectively publication number (European and international patents), the name of the patent holder, the filing date of the patent and the nature of the fee (upon payment of an annual fee for maintenance in force, it is imperative to specify the patent year). Where payment relates to an invoice, it is sufficient to state the number, date and originator of the invoice.

    Reasonable damages may be claimed as from the date of publication in French or German, or from the date of communication of a translation into French or German either to a defendant or to the Intellectual Property Office (Luxembourg) (Law of 27 May 1977).
    欧州特許を目的とする指定の場合：
    (1) International application published in one of the EPO official languages: compensation reasonable in the circumstances, on condition that any national requirements relating to the translation of the claims in the application have been met.
    (2) International application published in a language which is not an EPO official language: the protection referred to in (1) does not become effective until the EPO publishes the international application supplied to it in one of its official languages.

    国内段階の手続

    LU.01 国内段階移行のための様式
    The Office has available a special form for entering the national phase (see Annex LU.II).
    LU.02 翻訳文（補充）
    国際出願の翻訳文の誤りは、出願時の国際出願の本文を基準として補充することができる（国内段階6.002及び6.003項を参照)。
    LU.03 手数料（支払方法）
    概要及び本編に表示する手数料の支払方法は附属書LU.Ⅰに概説されている。
    LU. 04 発明者の氏名及びあて名

    国際出願の願書に記載されている場合を除き、発明者の氏名及びあて名を届け出なければならない。詳細については附属書LU.Ⅱの発明者の指定書の見本（公式な様式ではない）を参照されたい。認証は必要とされない。期間は概要を参照されたい。
    LU. 05 優先権の譲渡証

    先の出願を基礎とする優先権が主張されており、先の出願の出願人が国際出願の出願人と同一でない場合には、優先権の譲渡証を提出しなければならない。出願人又は代理人は簡易な書簡又は自身の様式により、譲渡に関する情報を当該官庁に提供することができる。認証は必要とされない。期間は概要を参照されたい。

    年金は国際出願日の第３年目以降の各年に対し支払わなければならない。国際出願日の各年の応当日が属する月の末日までに支払わなければならない。ＰＣＴ第39条(1)(a)に基づき適用される30箇月の期間内に支払期日となる年金は、30箇月の期間満了前であれば、割増料を伴わずに支払うことができる。年金は、期日後６箇月以内に割増料を伴い支払うことができる。額については附属書LU.Ⅰを参照されたい。
    LU.07 出願の補正及びその時期

    出願の主題の範囲を拡張しないことを条件として、ＰＣＴ第22条又は第39条(1)に規定する期間の満了から１箇月以内に、出願人は発明の名称、明細書、請求の範囲及び図面を補正することができる。補正は差替用紙により行い、同期間内に、管理手数料（附属書LU.Ⅰ参照）を支払わなければならない。
    LU.08 ＰＣＴ第25条の規定に基づく検査

    関係手続は国内段階6.018から6.021項に概説されている。ＰＣＴ第25条の規定に基づく検査に関し、国内官庁が受理官庁若しくは国際事務局の過失を否定する場合には、その決定から３箇月以内に当該決定に対する審判を請求することができる。その後、国家委員会が審判について決定する。
    LU.09 権利回復
    LPL Art. 40
    出願人は、状況に応じて要求される注意を払っていたにもかかわらず期間を遵守しなかった場合、権利回復を請求できる。権利の回復の申請は，根拠とする理由を述べなければならす、遵守されなかった期間の満了から１年以内に行わなければならない。権利回復の申請が認められた場合、出願人は、権利回復（restitutio in integrum）手数料を支払わなければならない。
    LU.10 期間を遵守しなかったことによる延滞についての許容

    出願人の責に帰することのできない理由のために所定の期間内（LU.05参照）に年金を支払うことができなかった場合には，権利の失効から20箇月以内に、回復を請求することができる。請求では，支払の遅延がその出願人の責に帰することができなかった理由を述べなければならない。回復請求を承諾する旨が決定された場合、出願人は回復手数料及び公報に回復の決定を公告するための手数料（附属書LU.Ⅰ参照）と共に、支払うべき年金及び割増料を支払うことが認められる。
